By accessing or using AppGenesis.ai (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

AppGenesis.ai is operated by Cristian Marin ("we," "us," or "our"). These terms govern your access to and use of the Service, including any content, functionality, and services offered.

2. Use of Service

2.1 Account Registration

3. AI-Generated Content

3.1 Content Disclaimer

The Service uses artificial intelligence to generate SwiftUI code and app content. While we strive for accuracy and quality, we do not guarantee that all AI-generated content will be error-free, secure, or suitable for your specific purposes.

3.2 Code Ownership

You retain all rights, title, and interest in the code generated through the Service. We do not claim ownership of your projects or generated content.

3.3 Your Responsibility

You are solely responsible for:

• Reviewing and testing all generated code before use
• Ensuring compliance with App Store guidelines
• Ensuring your app does not violate any laws or third-party rights
• Obtaining necessary licenses for any third-party components or APIs

4. Subscription and Billing

4.1 Subscription Plans

We offer various subscription plans with different credit allocations and features. All fees are in U.S. dollars and are non-refundable except as required by law or as explicitly stated in these terms.

4.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to your remaining credits until that date.

4.4 Payment Processing

All payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for all fees associated with your subscription.

4.5 Fair Use

While we provide credit allocations with each plan, we reserve the right to limit or suspend service if we detect abuse, excessive usage that impacts system performance, or violations of these terms.

5. Intellectual Property

The Service, including its original content, features, and functionality, is owned by AppGenesis.ai and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the Service will be accurate or reliable
• Generated code will be free from bugs or security vulnerabilities
• Apps created with the Service will be accepted by the Apple App Store

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL APPGENESIS.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or errors in generated code
• Any rejection of your app by the Apple App Store or other app stores
• Any content obtained from the Service

8. Indemnification

You agree to indemnify, defend, and hold harmless AppGenesis.ai and its affiliates from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
